Stanley Kamalu

I am a Solicitor in the construction, engineering and environmental projects group at Clarkslegal LLP, based in the London office. Having previously worked at a large City and national firm, I specialise in non-contentious and contentious law, and have acted for a wide range of construction professionals such as architects, engineers, quantity surveyors and other consultants, contractors and sub-contractors, as well as insurance professionals.

I have extensive experience with the drafting, review and negotiation of a variety of standard forms of professional appointment contracts including the NEC3 PSC; JCT; RIBA forms; GC/Works; FIDIC Model Services Agreement; RICS Standard Forms; CIC Consultants’ Contract Conditions; and PPC 2000. I have also reviewed bespoke professional appointments, collateral warranties, novation agreements, and third party rights agreements.

Additionally, I regularly deliver seminars to clients on a broad range of construction and insurance topics.

I have drafted, reviewed and negotiated on behalf of construction professionals to reduce their exposure to risk when entering complex contractual arrangements with other parties on nationally and internationally based projects.

My experience acting for professional indemnity insurers has helped me to develop a particular understanding of the risks that construction clients are faced with at each stage of a project.

In addition, I have expertise in dealing with ad-hoc queries from construction and insurance professionals seeking clarification of the interpretation of particular legal principles. This has included for example providing advice on the implications of granting a copyright licence, and considering practical and technical issues relating to retention of services upon novation.

I have provided a non-contentious drafting and review service to professional indemnity brokers, Insurers and their Insureds on multi-faceted advice schemes.

I have also completed in-house work with a leading insurance firm in both their Lloyd’s of London Insurance Box and their London based claims department, and worked with an in-house corporate team of a large energy company.

I have experience in advising clients such as quantity surveyors, architects, sub-contractors, developers, purchasers, and other commercial organisations in bringing or defending claims for professional negligence as well as supporting clients in fee recovery actions.
