Contact Ruth Wilkinson
I am a partner of Clarkslegal in the construction and engineering group. I joined Clarkslegal in March 2017. I previously worked in London specialising in construction law at CMS Cameron McKenna LLP (following its merger with Dundas & Wilson LLP) and Mayer Brown International LLP.
I have over 10 years’ experience in construction and engineering advising on both construction disputes and front end contract advisory work acting on behalf of employers, developers, contractors, specialist subcontractors and professional consultants. I have been involved in a range of different projects including retail, hospitals, schools, hotels, mixed use developments, power stations, process engineering, road, rail and large utility contracts. I prefer to work closely with my clients to understand their business and commercial needs and tailor my legal advice and strategy to suit them and their requirements.
I am a member of the Society of Construction Law (SCL) and the Technology and Construction Solicitors Association (TeCSA). I am also the SCL Joint Regional Coordinator for the Reading region. I write regularly for industry publications and have twice served as a judge for the Construction News Specialist Awards.
My work is diverse and challenging. I have advised on many types of construction disputes including defective works, extensions of time, loss and expense and professional negligence. I have pursued and defended claims in adjudication, arbitration and court proceedings. I am a solicitor-advocate and conduct some of my own advocacy.
Whatever direction a dispute may take, I keep an eye on the bigger picture and seek to resolve and handle disputes to help manage and monitor costs and reach commercial settlements where appropriate and/or possible.
I work alongside clients to actively manage any issues or problems that may arise to try to avoid the escalation of a dispute which could compromise ongoing commercial relationships and adversely affect the success of the project. I have provided advice throughout the life of a project in relation to the interpretation and application of various standard form contracts including JCT, NEC3, FIDIC and IChemE as well as bespoke and PFI contracts. For example, I have advised the client’s commercial or project team on specific issues such as completion and defects during the works to help maintain the smooth running of the project.
I have experience of drafting and reviewing construction contract documentation. I advise contractors and consultants on proposed contract terms at tender and contract award stage to help them identify and thus price any key contract risks.
I spent six months on secondment to a large contractor client in 2008 advising on tender bids and contract and procurement issues.
I often provide clients with tailored workshops and training on specific topics or issues. For example I have provided training on the operation and management of the NEC3 form of contract, payment mechanisms and adjudication.
