Our People

Louise Keenan

I advise both companies and individuals on a wide range of employment law matters from complex disciplinary issues to transfers under the Transfer of Undertaking Regulations (TUPE) and restructures. I have clients across a wide variety of sectors and have experience dealing with sector specific government initiatives.

This aspect of my work is extremely vast and varied. There’s too much to list here but as a taster, in addition to the areas mentioned below, I provide advice to companies and individuals on disciplinary and grievance procedures, sickness absence, redundancies, restructures, procedures for consultation and the election of employee representatives, breach of contract issues, post-termination restrictions and data access requests.

I have advised companies of all sizes on TUPE. In particular, I commonly advise on the application of TUPE and its effect and provide practical and commercial advice throughout any TUPE process. I can offer strategic advice on negotiations should any dispute arise and support clients in mitigating the risks associated with TUPE which may include drafting warranties and indemnities in commercial agreements and assisting with tri-partite settlement agreements.

I advise companies on unfair dismissal in both preventative and reactive environments. On the preventative side, I provide day to day advice and training on procedures and assist with drafting correspondence and negotiating settlement terms. On the reactive side, if a tribunal claim is received, I can provide assistance with all aspects of the employment tribunal process from drafting a defence to representing the company at the tribunal.   I also advise individuals on their rights and any potential unfair dismissal claim and can provide assistance with employment tribunal claims and settlement agreements for individuals.

I regularly advise on discrimination issues including discrimination on the grounds of age, sex, disability and maternity. This can involve identifying potential risks for a company at an early stage and advising and providing training on ways for the company to mitigate these risks or providing advice and support to companies or individuals if claims arise.

I have extensive experience in advising both companies and individuals on the terms and effect of settlement agreements and negotiating with other solicitors, ACAS, companies and individuals to obtain more beneficial settlement terms for my clients.

I advise companies on employee engagement issues including setting up employee forums, union recognition and management of actual or anticipated employee relations issues.
