I am an associate in the construction, engineering and environmental projects group at Clarkslegal LLP, based in the Reading office. Prior to joining the firm, I helped set up a legal consultancy targeted at SMEs in the construction industry, with a focus on risk management and dispute avoidance.
I believe that contractual risk can be best managed by having the right advice at the right time, from advice on procurement strategy and contract negotiation, through operation of contractual mechanisms, to enforcement and, if necessary, dispute resolution.
As well as construction contracts, I have advised on the drafting, amendment and negotiation of collateral warranties, novation agreements, and development agreements.
I have particular experience acting for specialist consultants in reviewing, drafting and negotiating appointments, including industry standard forms of contract such as JCT and NEC3 as well as bespoke forms.
I have advised on the operation of facilities maintenance contracts, including providing training to clients on the operation of contractual mechanisms.
I also have experience in advising on contractual queries which arise as projects progress, from professionals seeking advice on the meaning and application of specific provisions to negotiation of deeds of variation.
I have substantial experience in the field of dispute resolution. I particularly enjoy assisting clients in resolving disputes without the need to resort to formal procedures, where appropriate. I also have extensive experience in co-ordinating and advising on e-disclosure of large volumes of documents, including conducting complex and commercially sensitive collections and reviews.
I have advised on and assisted with litigation in the County Courts, High Court and Court of Appeal. I also have experience in working as part of a team on corporate/commercial cases arising out of construction developments where a thorough understanding of the factual background is critical to the case.
In addition, I have advised employers, contractors and consultants on their options and the process of adjudication.
