Emma Butcher

After graduating from King’s College London and completing my legal practice course at Oxford Institute of Legal Practice, I qualified in 2011 before joining Clarkslegal in 2013. I work from the firm’s Reading office and like all of the litigation team, my work is very diverse. I am experienced in dealing with a variety of commercial disputes including resolving disputes via alternative methods of dispute resolution such as mediation.

I also have a particular interest in the following areas:

I work closely with the firm’s Commercial Property team in dealing with landlord and tenant disputes, including contested lease renewals, dilapidations claims, forfeiture and service charge disputes. I also advise landlords on their obligations in relation to their residential property portfolios.

Along with other members of the team, I advise both commercial agents and principals on their rights and obligations under the Commercial Agents (Council Directive) Regulations 1993. I regularly write articles on this area for AgentBase, a trade organisation for commercial agents.

I have acted on a number of challenges to tender awards under the Public Contracts Regulations. Although issuing proceedings is often necessary in such cases due to the very tight timescales imposed by the legislation, I have on a number of occasions been able to achieve results for my clients without the need for formal legal action, including obtaining re-runs of tenders where proper processes have not been followed and obtaining the award of a contract to my client following an initial decision to award it to another bidder.
