Tribunal fees to be introduced

Currently claimants can start claims in the Employment Tribunal without paying any fee, however fees are common in the court system. The Chancellor announced at the Conservative Party Conference that from April 2013 the following fees will be introduced in the Employment Tribunal System and claimsnts will have to pay; 

  • £250 when applying to a tribunal and
  • a further £1000 will be payable by claimants when a hearing is listed.

If the claimant wins their case they have the fees refunded and if they lose they forfeit the fees.

So called poor claimants will be exempt from the fees, but this has not been defined although it has been suggested that this will be extended to the unemployed on income support benefit.

Further details of the fees are awaited and whether the fees deter vexatious claims is yet to be seen.
