Proposed TUPE changes now expected to come into force in January 2014

Employmentbuddy’s February article gave details on the proposed major changes to Transfer of Undertakings (Protection of Employment) Regulations 2006 (SI 2006/246) (TUPE); further to this it is now being reported that the changes are planned to be introduced in January 2014 and will not come into force in October 2013 as originally intended.

Following the consultation on proposed changes to TUPE, including the repeal of the service provision change and the employee liability information provisions, the government had proposed to implement the changes in October 2013. However, reports state BIS has now confirmed that the changes are likely to come into force in January 2014. The government intends to publish its response to the consultation in early September but is still finalising the timescale for the changes. It is hoping to lay the draft regulations before Parliament in December 2013.
