New right for all employees to request flexible working delayed

24 January 2014 #Employment

We recently reported that as of 6 April 2014 new rules governing the right to request flexible working under the Children and Families Bill would be introduced.

Currently only employees with at least 26 weeks` continuous employment who have children under the age of 17 (18 if the child is disabled) or who are carers have the right to request flexible working.  Furthermore, specific statutory procedures must be followed when making and considering a request.  However, under the new Bill all employees with at least 26 weeks` continuous service will have the right to request flexible working and employers will no longer need to follow the statutory procedure in dealing with and responding to such requests.

However, it has been reported that owing to delays with the Bill this change will no longer come into force on 6 April 2014.  Whilst a new implementation date has yet to be formally announced, the government has stated that it will come into force at “an appropriate date as soon as possible this year”.
