The Central London Employment Tribunal is trialing a new system whereby an ACAS Conciliator is present at the tribunal office to assist parties in conducting settlement discussions.
Parties who are at tribunal for a case management discussion (CMD) are asked whether they are agreeble to the Conciliator sitting in on the CMD. This is intended to give the Conciliator a better understanding of the issues in the case and therefore put them in a better position to facilitate a settlement.
We have often found that face-to-face negotiations at tribunal have been much more conducive to agreeing settlement terms than the usual telephone based ACAS process. The pilot initiative means that parties who reach agreement can have the benefit of an ACAS Conciliator on hand to finalise the terms of the settlement to achieve a binding agreement, saving time and money for all concerned. Let`s hope the pilot is a success and is rolled out across the tribunal system.
