Home Office publishes updated Sponsorship policy guidance

20 November 2020 #Immigration #Brexit

The Home Office has now published their policy guidance for the new immigration system which goes live on 1 December 2020. The new policy guidance update covers the Skilled Worker and the Intra Company Transfer routes.

The updated guidance is now divided into 5 parts which cover all aspects of Workers and Temporary Worker sponsorship. The guidance, which will be effective from 1 December 2020, is binding upon sponsors. The updated guidance covers:

  • Applying for a Sponsor Licence
  • General information to sponsor a worker
  • Sponsor duties and compliance
  • Sponsor a ‘Skilled Worker’
  • Sponsor a ‘Intra-Company’ worker.

It is important for organisations to ensure that the comply with any conditions or duties imposed by this guidance. A failure can lead to compliance action being taken against them. For serious breaches, the Home Office can suspend or revoke a sponsor licence.

At Clarkslegal, we regularly provide training to organisations to ensure they keep up to date with their sponsor duties. We cover all aspects of the sponsorship licencing process from applying for a licence to maintaining an existing licence. Our immigration team works closely with our employment team to ensure that an organisation is compliant with both immigration and employment law.
