Fair to sack by text?
10 June 2011
The short answer is no! We are surprised that a Tribunal in Australia was even asked to consider it.
In a recent case, employee Sedina Sokolovic was sacked (on Boxing Day no less) by a text reading "you can pick up your pay tomorrow and drop the key. You don`t need to call me and I don`t see that we can work together".
Fair Work Australia ruled that her sacking was unjust and unreasonable, awarding her almost $10,000.
This would no doubt also be unfair in the UK as a fair dismissal requires employers to have a fair reason to dismiss AND to follow a fair procedure.
