Business and Property Courts open for business

06 October 2017 #Dispute Resolution

The Business and Property Courts (B&PC) opened on 2 October 2017.  The B&PC is an umbrella for several specialist business courts and encompasses the Commercial Court, the Technology & Construction Court and what was previously the Chancery Division, covering intellectual property, insolvency and financial services disputes. 

It is intended that the B&PC gives a user friendly and recognisable term, particularly for litigants based overseas.  As well as being based in the Rolls Building in London, the B&PC is located in Manchester, Birmingham, Bristol, Leeds and Cardiff.  There is no restriction on large cases being brought in non-London based courts.

Existing users of the Rolls Building may not notice many immediate changes, beyond the need to allocate claims to a particular list and sometimes a sub-list within the B&PC.  Claims will also have new headings.  The B&PC will continue to allow claims to be issued electronically, as was already the case in the Chancery Division and will now be more widespread.
