Simon Berry

My time is divided between residential property and private client work. I always endeavour to provide clear and straightforward advice and offer practical and commercial solutions to my clients. I am fortunate that my workload constitutes many repeat clients, some of whom I have acted for many years.

I have experienced gained from working for more than twenty-five years in the Thames Valley on all aspects of freehold and leasehold sales and purchases and remortgages. Much of my work is from existing clients and from both private and professional recommendations. I act for a number of clients with substantial property portfolios.

I act for both Landlords and Tenants in respect of applications under the 1993 Leasehold Reform Act and the associated preparation of Notices and Counter Notices and the drafting of new Leases.

I am regularly instructed to act on the sales of property and land by Auction to include the preparation of the legal pack. I also act on behalf of prospective purchasers, many of which are recommended by local auctioneers, advising my clients on the documentation provided.

I have considerable experience in the administration of estates having acted on a number of substantial matters which include complicated tax considerations, missing beneficiaries and overseas assets. I advise on the marketing of properties and the preparation of Deeds of Variation.

Something we all tend to avoid talking about but which is essential to have in place to ensure that our wishes are met after we are gone!

I enjoy meeting clients to discuss their Wills and providing estate planning advice with a view to mitigating tax and to consider how best they might protect their assets. I advise a number of clients locally with substantial agricultural land and business property.

The preparation of Lasting Powers of Attorney and attorney management through our associated company Clarks Trustees Limited are growing areas of work. I also advise on Court of Protection and Office of Public Guardian applications.

My work incorporates drafting Trust provisions both within Wills and setting up lifetime Settlements. This includes preparing Deeds appointing and retiring Trustees and the drafting of Declarations of Trust when property is purchased in joint names.
