There is a procedure in place for Tribunals to ensure that documents are sent out on the ‘date sent` stamped on it as this is presumed to be the date from which time limits will run. However, in the case of Tasneem v Dudley Group of Hospitals NHS Trust an employee was able to challenge the accuracy of the date of when a Judgment was sent to him and was able to show that it was posted out at a later date. This meant he was in time to lodge an appeal.
It may be helpful to keep the postmarked envelope of documents sent by the tribunal, so that incorrect time limits can be challenged.
